Terms of Service
The terms that apply to this website and to our fabrication and manufacturing services.

1. Acceptance and scope
These Terms of Service (“Terms”) apply to this website and to precision fabrication and manufacturing services provided by Byers Precision Fabricators, Inc. (“Byers Precision,” “we,” “us”), including machining, forming, welding, finishing, and turnkey manufacturing. By using this website or requesting services from us, you agree to these Terms. If a written project agreement or purchase order accepted by us in writing conflicts with these Terms, the written agreement controls for that project.
2. Services
We provide custom metal fabrication and manufacturing services, which may include precision fabrication, machining, forming, welding, finishing, assembly, and turnkey manufacturing. The services included in a given project are those described in the quote or project agreement for that project. Information on this website is general and is not an offer to perform specific work.
3. Customer drawings and specifications
You are responsible for the accuracy and completeness of the drawings, specifications, CAD files, and other technical information you provide, and for the suitability of your design for its intended use. We perform work according to the information provided. Please tell us promptly if requirements change or if you identify an error.
4. RFQs and estimates
A request for quote (RFQ) is an invitation for us to review your requirements. Quotes and estimates are based on the information provided, are valid only for the period stated in the quote, and are not a binding commitment to perform work until a project agreement is in place. Pricing and schedules may change if the requirements, quantities, or materials differ from what was quoted.
5. Project agreements
A project is agreed when you accept our written quote, issue a purchase order that we accept, or sign a project agreement with us. The agreed scope, price, schedule, and any additional terms for the project are set out in those documents.
6. Pricing, invoices, and payment
Payment is invoice-based. Invoices are issued according to the quote or project agreement, and payment is due as stated on the quote, agreement, or invoice. Where applicable, we may require a deposit before work begins or milestone payments as the project progresses, as stated in the quote or project agreement. Taxes and shipping charges, where applicable, are additional unless stated otherwise.
7. Customer-requested changes
Changes to drawings, specifications, quantities, materials, finishing, or schedule must be requested in writing. We will let you know how a requested change affects price and schedule, and a change takes effect once it is agreed in writing.
8. Materials
Where applicable, materials are either supplied by us as described in the quote or furnished by you. You are responsible for specifying the materials required for your parts, and for the condition and suitability of any materials you furnish. Material substitutions are made only with your approval. Material availability and pricing may affect cost and schedule.
9. Production scheduling
Schedules and lead times are estimates unless we expressly commit to a firm date in writing. They depend on timely receipt of complete drawings, specifications, approvals, materials, and payments, and may change with project scope or circumstances outside our reasonable control.
10. Cancellations
To cancel or suspend a project, you must notify us in writing. If work has begun, you are responsible for payment for work performed, materials purchased or committed, and other costs incurred up to the cancellation, as further described in the project agreement. Custom parts made to your specifications may not be returnable.
11. Inspection and acceptance
You are responsible for inspecting delivered parts and notifying us in writing of any claimed nonconformance with the agreed drawings and specifications within the period stated in the project agreement or, if none is stated, within a reasonable time after delivery. Parts that are not rejected within that period are considered accepted, except for defects that could not reasonably have been discovered by inspection.
12. Shipping and delivery
Where shipping or delivery applies, the delivery method, shipping terms, and responsibility for freight charges are set out in the quote or project agreement. Delivery dates are estimates as described in Production scheduling above. Risk of loss passes as stated in the project agreement.
13. Customer intellectual property and technical documents
Your drawings, specifications, CAD files, and technical documents remain your property. You grant us permission to use them solely to review, quote, and perform the work you request, and we will not use them to make parts for anyone else. You represent that you have the right to provide them to us. You are responsible for identifying, before you send them, any export-controlled, classified, or otherwise restricted technical data and for contacting us first so we can discuss how to proceed.
14. Warranties
We provide a warranty on our work only where one is expressly stated in a written quote or project agreement. Except as expressly provided in writing, and to the fullest extent permitted by law, we disclaim all other warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose.
15. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or loss of use, arising from our services or this website. Our total liability for any claim relating to a project is limited to the amount you paid us for the specific services or parts giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Use of this website
This website is provided for general information about our company and to let you contact us. Descriptions of industries and services are not statements of certification, approval, or program participation. You agree not to misuse the website, interfere with its operation, or submit unlawful or harmful content.
17. Governing law
These Terms and any project or dispute arising from them are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any legal action will be brought in the state or federal courts located in North Carolina, unless a written project agreement states otherwise.
18. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page shows the most recent revision. Terms agreed in writing for a specific project are not changed by later updates to this page.
